India's Single-Use Plastic Ban: What Food Businesses Still Don't Know in 2026

India's single-use plastic ban began in earnest in July 2022. Four years on, a significant portion of food businesses — restaurants, cloud kitchens, caterers, street vendors — are still using items that are now illegal. Not out of defiance, but out of a combination of incomplete information, uneven enforcement, and the assumption that someone would have told them if they were really breaking the rules.

In 2026, that assumption is becoming expensive. Here is what has changed, and what your business needs to do about it.

WHAT IS ACTUALLY BANNED

The 2022 ban identified specific single-use plastic items prohibited from manufacture, import, stocking, distribution, sale, and use. For food businesses, the most relevant prohibited items are:

•      Plastic cutlery — forks, knives, spoons, and sporks

•      Plastic straws (including those on juice cartons)

•      Plastic stirrers

•      Thermocol / expanded polystyrene food containers and cups

•      Plastic carry bags below 120 microns

•      Plastic wrapping around sweet boxes and invitation cards

If your restaurant sends out plastic cutlery with deliveries, uses thermocol containers, or provides plastic bags below the 120-micron threshold, you are in breach of existing law.

WHAT THE 2026 AMENDMENTS ADD

The Plastic Waste Management (Amendment) Rules 2026, notified by the MoEFCC on 31 March 2026, tighten the framework further. The key additions for food businesses:

•      EPR compliance is now mandatory: businesses that generate plastic packaging waste above a threshold must register on the CPCB EPR portal

•      Recycled content mandates: producers of rigid plastic packaging must use 30% recycled content in 2025-26, rising to 60% by 2028-29

•      Certified compostable packaging is exempt from plastic waste EPR calculations — a meaningful incentive to switch

•      Decentralised enforcement: urban local bodies now have direct authority to inspect, issue challans, and collect penalties

•      Digital evidence admissible: CCTV footage, photographs, and video can be used to establish violations

WHAT THE PENALTIES ACTUALLY LOOK LIKE

This is where many business owners are surprised. Penalties under the Environment Protection Act 1986 (as amended by the Jan Vishwas Act 2023) are not trivial:

•      Administrative fines of up to Rs 15 lakh for violations

•      Specific fines: Rs 5,000 per tonne for plastic bags below 120 microns

•      EPR non-compliance: fines up to Rs 1 lakh per instance

•      Ladakh has already imposed Rs 10,000 per violation for commercial establishments (June 2026)

•      Manufacturers of banned items face licence suspension

In the first month of enforcement in 2022, more than 775,000 kg of illegal plastics were seized and Rs 5.8 crore collected in penalties across India. Enforcement has only tightened since.

WHAT COMPLIANT PACKAGING LOOKS LIKE

The practical switches are straightforward:

•      Bagasse containers and clamshells — for food delivery and takeaway

•      Birchwood or CPLA cutlery — for individual cutlery sets

•      Paper straws certified under BIS standards — for beverages

•      Compostable carry bags certified to IS 17088 — for takeaway

•      Kraft paper bags — for dry food packaging

Important: packaging labelled 'biodegradable' without IS 17088 certification or an equivalent recognised standard can still attract a penalty. The certification matters, not just the claim.

THE PRACTICAL UPSIDE

Businesses that have already made the switch report that certified compostable packaging reduces their EPR compliance burden significantly, improves their positioning with delivery platform sustainability criteria, and has become a genuine customer preference driver in metro markets.
